Terms of Use and Licence (EULA) — Groundwork

These terms are a licence agreement (an "EULA") and terms of use for the iOS app Groundwork (on the App Store as "Groundwork: Sobriety Companion"). They are between you and the publisher named in section 15. Please read the short summaries in italics if nothing else.

1. Who we are and how you accept these terms

In short: the app is published by one person trading as Steadwright. You accept these terms when you tap "I understand and agree" on the first screen.

"We", "us" and "Steadwright" mean an individual (not a company) trading as Steadwright. Our contact details are in section 15. "You" means the person using the app.

The first time you open Groundwork, it shows a short summary of the most important points and links to these terms and the Privacy Policy. You accept these terms by tapping "I understand and agree". If you do not agree, do not use the app. If we make a material change, the app will ask you again.

2. What Groundwork is, and what it is not

In short: Groundwork is a private tracker and self-management tool for adults. It is not medical care, it is not treatment, and it cannot promise any result.

Groundwork helps you work towards your own goal about alcohol: drinking less, or not drinking. You can set a goal, log check-ins and urges, write if-then plans, set reminders, and look back at your own patterns.

Groundwork is not a medical device and not a treatment. It does not diagnose, screen, assess, monitor, treat, cure or prevent any illness or condition, including alcohol dependence or alcohol withdrawal. Any short questions the app asks are there to help you reflect and to point you to medical help. They are not a medical assessment, and they cannot tell you whether it is safe for you to stop or cut down.

The app cannot guarantee any result. It does not promise that you will stop, cut down, stay stopped, or avoid any harm. Lapses happen; the app is designed to treat them as information, not failure.

The health and coping information in the app is drawn from named public sources, which are cited on each screen. It is general, population-level information. It is not advice about you. The content was written and checked by the app's author, who is not a clinician; it has not been reviewed by a doctor. 3. Safety first

In short: if you are in danger, call your local emergency number. The app is not monitored and cannot help in an emergency.

This section is a safety message. It does not take away any right you have under the law.

4. Who can use the app

In short: you must be 18 or older.

You must be at least 18 years old to use Groundwork. The app is not designed for children.

5. Your licence

In short: you may use the app on Apple devices you own or control, for your own personal use.

We give you a personal, non-exclusive, non-transferable licence to use Groundwork on any Apple-branded device that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions (including Family Sharing, where Apple supports it for this app). You may not:

6. The paid upgrade (Groundwork Plus)

In short: one optional one-time purchase through Apple. No subscription. Apple handles payment and refunds. Safety features are always free.

7. Your data

In short: what you enter stays on your device. We cannot see it, recover it or delete it for you.

Groundwork has no accounts and no server. What you enter is stored only on your device. We never receive it. The Privacy Policy explains this in detail: https://steadwright.net/legal/groundwork/privacy

8. Updates and how long we support the app

In short: we intend to keep the app working and secure for a reasonable period after you buy.

We aim to provide updates, including security updates, that are needed to keep Groundwork working as described on supported iOS versions. We intend to keep Groundwork available and working for at least 24 months after your purchase. If we ever plan to stop supporting the app, we will say so in the App Store release notes and in the app before support ends. Updates may change features, but we will not remove features you paid for without a legally valid reason.

In short: nothing here takes away the rights consumer law gives you.

If you are a consumer, you have legal rights that a contract cannot take away. These include, where they apply, rights about digital content being as described, fit for purpose and of satisfactory quality, and rights to a repair, replacement, price reduction or refund. Nothing in these terms limits those rights. For more information, contact a consumer advice service in your country.

10. Warranty

In short: we provide the app with reasonable care, but cannot promise it will be error-free. Apple's only role is a possible refund.

To the extent the law allows, the app is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, or that it will meet goals the app does not claim to meet (see section 2).

If the app fails to meet any warranty that applies to it, you may tell Apple, and Apple may refund the purchase price you paid. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claim about a failure to meet a warranty is our responsibility, not Apple's, to the extent the law makes anyone responsible.

11. Our liability to you

In short: we never exclude liability the law does not let us exclude, such as for death or injury caused by our negligence. Otherwise we are responsible only for foreseeable loss.

12. Ending these terms

In short: you can stop at any time. We can end your licence only for a serious breach.

You can stop using Groundwork at any time by deleting it. Deleting the app removes its data from your device (see the Privacy Policy). Your licence ends automatically if you seriously break section 5. Ending the licence does not affect rights you have under consumer law, or rights and duties that already exist.

13. Changes to these terms

In short: we will date every change and ask you again for material changes.

We may change these terms, for example to reflect a new feature or a change in the law. The "Last updated" date will change. For a material change, the app will ask you to read and accept the new terms; we will also mention it in the release notes. A change does not apply to a dispute that started before the change.

14. Law and courts

In short: Ukrainian law applies, but if you are a consumer you keep the protection of your home country's law and can go to your local courts.

These terms are governed by the law of Ukraine. If you are a consumer, you also keep the protection of the mandatory rules of the law of the country where you live, and nothing in these terms takes that away. If you are a consumer, you may bring a claim in the courts of the country where you live, and we can bring a claim against you only there. If you are not a consumer, the courts of Ukraine have jurisdiction. These terms do not include binding arbitration or a class-action waiver.

Please send questions, complaints and claims about Groundwork to us, not to Apple.

16. Apple-specific terms

In short: this agreement is with us, not Apple. Apple can enforce it as a third-party beneficiary.

17. Other documents

If a part of these terms is found invalid, the rest still applies. If we do not enforce a right straight away, we do not give it up.
